These Terms of Service (the “Terms”) apply when you use Draw on a Map, including our website, map tools, accounts, saved maps, exports, embeds, and paid features (together, the “Service”). The Service is maintained by Sunshine Projects (“Draw on a Map,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use the Service
You must be legally able to enter into a binding agreement where you live. If you use the Service for a company or other organization, you confirm that you have authority to accept these Terms for that organization.
2. What the Service does
Draw on a Map lets you draw, annotate, measure, save, share, export, and embed maps. Some features work without an account. Accounts and payment may be required for saved maps, higher limits, password-protected sharing, clean exports, service-area widgets, or other paid features.
Map data, geocoding results, routes, boundaries, measurements, and location information may be incomplete, delayed, or inaccurate. Do not rely on the Service for emergencies, navigation where errors could cause harm, surveying, legal boundaries, or other safety-critical decisions.
3. Accounts and security
You are responsible for activity under your account and for keeping access to your email and sign-in links secure. Give us accurate information and tell us promptly if you believe your account has been accessed without permission. We may suspend access when reasonably necessary to protect you, the Service, or others.
4. Your maps and content
You keep ownership of drawings, labels, business details, boundaries, and other content you create or submit (“Your Content”). You give us a non-exclusive, worldwide, royalty-free license to host, process, reproduce, and display Your Content only as needed to operate, secure, and improve the Service and to share, export, or embed it as you direct.
You are responsible for Your Content and must have the rights needed to use and share it. Do not submit personal, confidential, unlawful, infringing, or harmful content. Standard share links can contain map data in the URL itself; anyone with the link may be able to view that data. Public saved maps and published widgets may be available to anyone with their link.
5. Acceptable use
You may not:
- use the Service or Your Content to break the law or violate another person’s rights;
- upload malware or attempt to gain unauthorized access to accounts, systems, or data;
- interfere with the Service, evade limits, or place an unreasonable load on our infrastructure or third-party map providers;
- scrape, bulk-download, or systematically extract map tiles or data in violation of a provider’s terms;
- misrepresent the source, accuracy, or official status of a map; or
- use the Service to make decisions where inaccurate map information could foreseeably cause injury or serious damage.
6. Paid features, billing, and cancellation
Prices, billing intervals, included features, taxes, and any one-time payment terms are shown before purchase. Subscription plans renew automatically at the interval and price shown at checkout until canceled. You can cancel future renewals through the Stripe billing portal linked from the Pro page. Unless the checkout terms say otherwise, cancellation takes effect at the end of the current paid billing period.
Checkout is provided through Stripe Managed Payments, with Link acting as merchant of record where shown at checkout. Link or Stripe processes payment details, taxes, receipts, refunds, disputes, and transaction support under the terms presented during checkout. We do not store your full payment card number.
Refund and withdrawal rights depend on the purchase, the checkout terms, and the law that applies to you. Nothing in these Terms limits mandatory consumer rights. For billing help, use the support options in your Link receipt or email hello@drawonamap.com.
7. Third-party services and open map data
The Service depends on third parties such as Stripe, Link, OpenStreetMap contributors and tile providers, geocoding providers, and hosting services. Their services and content may be governed by their own terms and privacy policies. Map and boundary data attribution is available on the Data Attribution page and in the map interface.
8. Our software and branding
The Service, including its software, design, and branding, belongs to us or our licensors. These Terms give you permission to use the Service, not ownership of it. You may not copy, sell, or redistribute our software or branding except where applicable law or a separate open-source license allows it.
9. Service changes and termination
We may change, limit, suspend, or discontinue parts of the Service. We will try to give reasonable notice when a material change affects a paid feature, unless an urgent security, legal, or operational issue prevents it. We may suspend or terminate access if you materially or repeatedly violate these Terms or create risk for the Service or others.
You may stop using the Service at any time. You can request account deletion by emailing hello@drawonamap.com. Canceling a subscription and deleting an account are separate actions.
10. Disclaimers
We provide the Service on an “as is” and “as available” basis. To the extent permitted by law, we do not make warranties about uninterrupted availability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that shared links, saved maps, exports, embeds, routes, measurements, boundaries, or third-party services will always remain available or error-free.
11. Limits on liability
To the extent permitted by law, Draw on a Map and its maintainers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, business, or goodwill arising from the Service. Our total liability for claims relating to the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim.
These limits do not apply where liability cannot legally be limited, including mandatory consumer protections.
12. Changes to these Terms
We may update these Terms as the Service or applicable requirements change. We will post the updated version here and change the “Last updated” date. If a change materially affects paid users, we will provide reasonable notice when required by law. Continuing to use the Service after updated Terms take effect means you accept them.
